Terms and Condition

By engaging Avondale Tree Service ("we," "us," or "our") in Avondale, AZ, you ("Client" or "you") agree to these Terms and Conditions.

1. Services

We provide professional tree care services, including tree removal, trimming, pruning, stump grinding, emergency storm response, and arborist consultations. Scope, timeline, and pricing are detailed in a written estimate or contract.

2. Estimates and Payments

  • Estimates: Valid for 30 days, based on site assessment and client-provided information.
  • Payments: Due upon job completion unless otherwise agreed. We accept cash, checks, and credit cards. Deposits may be required for large projects.
  • Late Fees: Overdue balances incur 1.5% monthly interest; services may be paused until paid.
  • Additional Costs: Unforeseen conditions (e.g., hidden roots, equipment needs) may increase costs, with prior client approval.

3. Client Responsibilities

  • Access: Ensure clear access to the work area. We are not liable for damage to items left in the work zone.
  • Permits: Client is responsible for obtaining permits unless we agree to assist (additional fee applies).
  • Utilities & Boundaries: Mark all underground utilities, irrigation lines, property lines, and hazards. We are not liable for damage to unmarked items.
  • Debris: Unless included in the contract, debris removal is the client’s responsibility (haul-away available for a fee).

4. Safety and Liability

  • Safety: Keep children, pets, and unauthorized persons away from the work area. We adhere to ANSI and ISA safety standards.
  • Liability: We are not responsible for unavoidable damage (e.g., falling limbs during removal) when reasonable care is exercised. We carry general liability and workers’ compensation insurance.
  • Force Majeure: Delays due to weather, acts of God, or equipment failure are not our responsibility.

5. Cancellations and Rescheduling

  • Cancellation: Written notice required 48 hours in advance. Cancellations within 48 hours incur a 20% fee of the estimate.
  • Rescheduling: Changes within 24 hours may incur a $100 fee, subject to crew availability.

6. Warranty

  • Workmanship: All work meets industry standards. Report concerns within 7 days for free correction (within original scope).
  • No Health Guarantee: Tree or plant survival is not guaranteed due to environmental or pre-existing conditions.

7. Disputes

Disputes will be resolved through good-faith negotiation or mediation in Maricopa County, AZ. Prevailing party may recover reasonable attorney fees.

8. Termination

We may terminate services for non-payment, unsafe conditions, or non-compliance. Client remains liable for completed work.

9. Intellectual Property

All plans, designs, and recommendations remain our property and may not be reproduced without written consent.

10. Governing Law

Governed by Arizona law. Legal actions must be filed in Maricopa County, AZ.
